Terms of Service
Tektari Inc. · effective 2026-06-24 · last updated 2026-07-03
1. Who we are
These Terms of Service ("Terms") are a binding agreement between you ("you," "your," or "Learner") and Tektari Inc. ("Tektari," "we," "us," or "our"), a Canadian corporation. Tektari is an applied-AI practice — independent verification and enablement for the people who design, build, and operate physical assets.
These Terms govern your access to and use of:
- the Tektari website at tektari.com and its subdomains (the "Site");
- our self-serve courses, workshops, cohort programs, and enterprise programs (together, the "Programs"); and
- any related content, datasets, software, tools, and services we make available (together with the Site and Programs, the "Services").
By creating an account, purchasing a Program, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services. If you are using the Services on behalf of an organization, you represent that you are authorized to bind that organization, and "you" includes that organization.

2. Eligibility and accounts
- You must be at least the age of majority in your jurisdiction (or have verifiable consent from a parent or guardian and be permitted by us in writing) to purchase a Program or create an account.
- You agree to provide accurate registration information and to keep it current.
- You are responsible for safeguarding your account credentials and for all activity under your account. Notify us promptly at hello@tektari.com if you suspect unauthorized use.
- Program access is personal to you and non-transferable. Accounts and licenses may not be shared, sold, or assigned unless we agree in writing (for example, under an enterprise agreement covering named seats).
3. Acceptable use of the Site and Services
You agree to use the Services lawfully and respectfully. You will not:
- copy, scrape, mirror, frame, or systematically download Site content or Program materials except as expressly permitted by these Terms;
- share, resell, sublicense, publicly post, or otherwise redistribute Program content, synthetic datasets, or your access credentials;
- circumvent paywalls, access controls, rate limits, watermarks, or other technical protections;
- reverse engineer, decompile, or attempt to derive source code or training data from our tools, except to the extent that restriction is prohibited by applicable law;
- upload or transmit malware, or interfere with, overload, or disrupt the Services or their infrastructure;
- use the Services to harass, defame, or infringe the rights of others, or to violate any law or third-party agreement;
- misrepresent your affiliation with Tektari, or use our name, logo, or marks without permission; or
- use the Services, or any output derived from them, in a way that violates the educational-use and safety provisions in Section 8.
We may investigate suspected violations and may suspend or terminate access for conduct we reasonably believe breaches these Terms or harms us, other users, or third parties.
Clean-room rule (important for everyone)
Tektari teaches with synthetic and generalized artifacts only. You agree not to upload, paste, or otherwise introduce into the Services any real employer, client, or project data — including confidential, proprietary, personal, regulated, or safety-critical information that you are not authorized to disclose. Keep your own work product in your own controlled environment. You are solely responsible for any data you choose to bring into exercises, and for ensuring you have the right to use it.
4. Purchases, access, and pricing
- Pricing and taxes. Prices are shown at checkout and may change over time; changes do not affect Programs you have already purchased. You are responsible for applicable taxes (e.g., GST/HST, sales tax, VAT) unless we state otherwise.
- Payment. Payments are processed by third-party payment providers. By purchasing, you authorize the applicable charge and agree to the payment provider's terms.
- Access window.
- Self-serve courses: access is granted for the duration stated on the course page (for example, lifetime access or a defined term). If no duration is stated, access continues for as long as we offer that course, subject to these Terms.
- Cohort programs: access covers the scheduled cohort and any post-cohort access window described at purchase.
- Enterprise programs: access is defined in the applicable order form or Master Services Agreement ("MSA").
- Delivery and changes. We may update, improve, reorder, retire, or substitute Program content to keep material current. We aim to preserve the core learning outcomes of any Program you have purchased.
- Availability. We may modify or discontinue features of the Services. If we retire a paid self-serve course you currently have access to and offer no replacement, we will provide reasonable notice and, where appropriate, a pro-rated remedy.
5. Refund policy
We want the refund terms to be clear up front. The policy depends on the type of Program. Statutory consumer-protection rights, where they apply, are in addition to the rights below and are not waived by them.
5.1 Self-serve courses — 14-day, completion-gated money-back
For self-serve courses, you may request a full refund within 14 days of purchase, provided you have not completed the course (or substantially all of it). "Completed" means you have finished all or substantially all of the course modules, lessons, or assessments, or have downloaded the bulk of the included materials. This completion gate exists so the guarantee covers genuine "this wasn't right for me" cases rather than full consumption of the material.
- Eligible refunds are issued to the original payment method.
- If the 14-day window has passed, or the course has been completed, the purchase is non-refundable except where required by law.
5.2 Cohort programs — refundable before Week 1
For cohort (live or facilitated) programs, you may cancel and receive a full refund any time before the start of Week 1 of the cohort. Once Week 1 has begun, the cohort fee is non-refundable, because seats are limited and facilitator capacity is committed in advance.
- Where available, we may offer to transfer your seat to a future cohort instead of a refund, at our discretion.
- If we cancel or materially reschedule a cohort, you may choose a full refund or a transfer to a later cohort.
5.3 Enterprise programs — per the MSA
Refunds, credits, cancellation, and termination for enterprise programs are governed by the applicable order form and/or MSA. Where those documents conflict with this Section 5, the order form/MSA controls for that engagement.
5.4 How to request a refund
Email hello@tektari.com from the address associated with your purchase, with your order details. We aim to process eligible refunds promptly. Refunds may take additional time to appear depending on your payment provider.
6. Intellectual property
6.1 Our content
The Services and all materials in them — including course videos, written lessons, slides, exercises, assessments, code samples, synthetic and generalized datasets, frameworks, methods, branding, and the design and structure of the Site — are owned by Tektari or our licensors and are protected by copyright, trademark, and other intellectual-property laws. "Tektari" and our logos and marks are our property. Except for the limited license in Section 6.2, no rights are granted to you.
6.2 Your license to learn
Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Program content and synthetic datasets you have purchased, solely for your own learning and internal professional development, for the duration of your access window.
This license does not permit you to:
- redistribute, publish, share, resell, sublicense, or publicly post the content or synthetic datasets;
- use the content or synthetic datasets to build, train, or market a competing course, dataset, or product;
- remove or alter proprietary notices, watermarks, or attributions; or
- provide your access to others or use it for the benefit of anyone other than yourself (enterprise seat terms, where applicable, govern named-user access).
Applying the skills and general knowledge you learn to your own work is encouraged and is exactly the point — what is restricted is redistributing our materials and datasets themselves. The synthetic datasets are provided for teaching only and must not be presented as, or relied upon as, real-world data.
We reserve all rights not expressly granted.
6.3 Feedback
If you send us suggestions or feedback, you grant us a perpetual, irrevocable, royalty-free license to use it without restriction or obligation to you.
7. User content
"User Content" means anything you submit, post, or upload through the Services — for example, exercise submissions, forum or community posts, questions, and project artifacts (synthetic only, per the clean-room rule).
- You own your User Content. You retain whatever rights you have in it.
- License to us. You grant Tektari a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and use your User Content as needed to operate and provide the Services (for example, to display your post to a cohort, or to give you feedback). If you submit content to public or community areas, you also license other users to view it within the Services.
- Your responsibilities. You represent that you have the rights to submit your User Content and that it does not infringe any third party's rights, breach any confidentiality obligation, or violate the clean-room rule in Section 3. Do not submit real client/employer/project data or anything you are not authorized to share.
- Moderation. We may, but are not obligated to, review, moderate, or remove User Content that we reasonably believe violates these Terms.
8. Educational use — no warranty; verify outputs; humans own sign-off
This section is important. Please read it carefully, especially if you work in safety-critical industries.
Tektari is education, not advice. The Services, including all Program content, datasets, tools, examples, and any outputs generated during exercises, are provided for educational and informational purposes only. They are not engineering, architectural, structural, geotechnical, environmental, legal, financial, medical, occupational-health-and-safety, or other professional advice, and they do not constitute a professional opinion, certification, or recommendation for any specific real-world project, asset, or decision.
No professional relationship. Using the Services does not create an engineer–client, lawyer–client, or other professional or fiduciary relationship between you and Tektari. We are not your engineer of record, designer of record, or advisor of record.
Synthetic data, illustrative results. Our datasets and worked examples are synthetic and generalized. They are designed to teach methods, not to represent any real asset, site, system, or condition. Results shown are illustrative and may not generalize to your situation.
AI outputs can be wrong. AI systems — including any models, tools, or workflows taught or used in the Services — can produce inaccurate, incomplete, biased, outdated, or unsafe outputs. You must independently verify any output before relying on it, and apply your own professional judgment, applicable codes, standards, and regulations.
A qualified human owns every sign-off. Nothing you learn or generate through the Services replaces the review, judgment, stamp, seal, or approval of a qualified, licensed, and accountable professional. For any real design, build, operation, inspection, or safety-related decision, a competent human must own the sign-off and bears responsibility for it. Do not deploy course outputs into production, safety-critical, or regulated contexts without appropriate professional review and validation.
As-is. To the maximum extent permitted by law, the Services are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or that any particular outcome (including learning, certification, employment, or commercial result) will be achieved.
Your responsibility. You are solely responsible for how you use what you learn, including compliance with all laws, codes, standards, permits, and professional obligations applicable to your work.
9. Limitation of liability
To the maximum extent permitted by applicable law:
No indirect damages. Tektari and its directors, officers, employees, contractors, instructors, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, or for any damages arising from reliance on the Services or any output, even if advised of the possibility of such damages.
No liability for real-world reliance. Without limiting Section 8, Tektari is not liable for losses, injuries, damages, regulatory actions, or claims arising from your application of educational content or AI outputs to real-world assets, projects, designs, operations, or safety decisions. A qualified human owns every sign-off.
Liability cap. Tektari's total aggregate liability arising out of or relating to these Terms or the Services, from all causes and under any theory of liability, will not exceed the greater of (a) the amount you paid to Tektari for the specific Program giving rise to the claim in the twelve (12) months before the event giving rise to liability, or (b) CAD $100.
Carve-outs. Nothing in these Terms limits liability that cannot be limited or excluded under applicable law (for example, certain consumer-protection rights, fraud, or liability for death or personal injury caused by negligence where such limitation is not permitted).
Some jurisdictions do not allow certain limitations or exclusions, so some of the above may not apply to you. In that case, our liability is limited to the greatest extent permitted by law.
10. Indemnification
You agree to indemnify and hold harmless Tektari and its directors, officers, employees, contractors, instructors, and licensors from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your misuse of the Services; (b) your breach of these Terms, including the clean-room rule; (c) your User Content; or (d) your application of educational content or AI outputs to any real-world project, asset, or decision.
11. Third-party services and links
The Services may rely on or link to third-party tools, platforms, and content (for example, payment processors, video hosting, AI providers, or external websites). We do not control and are not responsible for third-party services, and your use of them is governed by their own terms. Links are provided for convenience and do not imply endorsement.
12. Suspension and termination
- You may stop using the Services at any time.
- We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Services or other users.
- On termination, the licenses granted to you end, and you must stop using and delete any downloaded Program materials, except where a paid access window or applicable law provides otherwise.
- Sections that by their nature should survive termination — including Sections 6, 7, 8, 9, 10, 13, and 14 — survive.
13. Governing law and disputes
These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable there, without regard to conflict-of-laws principles. Subject to any non-waivable consumer-protection rights, you agree that the courts located in Ontario, Canada will have jurisdiction over disputes arising from these Terms or the Services.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you (for example, by posting the updated Terms on the Site with a new effective date, or by email). Changes apply prospectively. Your continued use of the Services after changes take effect constitutes acceptance. If you do not agree to the updated Terms, stop using the Services.
15. General
- Entire agreement. These Terms (together with any order form, MSA, or policy referenced here) are the entire agreement between you and Tektari regarding the Services and supersede prior agreements on that subject.
- Severability. If any provision is found unenforceable, the rest remain in effect, and the unenforceable provision will be limited to the minimum extent necessary.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure. We are not liable for delays or failures caused by events beyond our reasonable control.
- Notices. We may provide notices to you by email or by posting on the Site.
