Plain-language summary (not a substitute for the terms below). Tektari is an applied-AI academy. We teach you how to work with AI on physical-asset problems using synthetic, generalized examples. Our courses are education, not engineering, legal, or safety advice. Always verify what you produce, and make sure a qualified human owns every sign-off. Buy a course or program, get a personal license to use the materials, don’t redistribute them. Refunds work as described in Section 5. If something goes wrong, our liability is limited (Section 9).
⚠️ Legal review note: This document is a template prepared for Tektari and has not been reviewed by counsel. Have a qualified lawyer review and adapt it — including the governing-law, consumer-protection, tax, and dispute-resolution provisions — before publishing or relying on it.
These Terms of Service (“Terms”) are a binding agreement between you (“you,” “your,” or “Learner”) and Tektari Inc. (“Tektari,” “we,” “us,” or “our”), a Canadian corporation. Tektari is an applied-AI academy for the people who design, build, and operate physical assets.
These Terms govern your access to and use of:
By creating an account, purchasing a Program, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services. If you are using the Services on behalf of an organization, you represent that you are authorized to bind that organization, and “you” includes that organization.
Contact: hello@tektari.com
You agree to use the Services lawfully and respectfully. You will not:
We may investigate suspected violations and may suspend or terminate access for conduct we reasonably believe breaches these Terms or harms us, other users, or third parties.
Tektari teaches with synthetic and generalized artifacts only. You agree not to upload, paste, or otherwise introduce into the Services any real employer, client, or project data — including confidential, proprietary, personal, regulated, or safety-critical information that you are not authorized to disclose. Keep your own work product in your own controlled environment. You are solely responsible for any data you choose to bring into exercises, and for ensuring you have the right to use it.
We want the refund terms to be clear up front. The policy depends on the type of Program. Statutory consumer-protection rights, where they apply, are in addition to the rights below and are not waived by them.
For self-serve courses, you may request a full refund within 14 days of purchase, provided you have not completed the course (or substantially all of it). “Completed” means you have finished all or substantially all of the course modules, lessons, or assessments, or have downloaded the bulk of the included materials. This completion gate exists so the guarantee covers genuine “this wasn’t right for me” cases rather than full consumption of the material.
For cohort (live or facilitated) programs, you may cancel and receive a full refund any time before the start of Week 1 of the cohort. Once Week 1 has begun, the cohort fee is non-refundable, because seats are limited and facilitator capacity is committed in advance.
Refunds, credits, cancellation, and termination for enterprise programs are governed by the applicable order form and/or MSA. Where those documents conflict with this Section 5, the order form/MSA controls for that engagement.
Email hello@tektari.com from the address associated with your purchase, with your order details. We aim to process eligible refunds promptly. Refunds may take additional time to appear depending on your payment provider.
The Services and all materials in them — including course videos, written lessons, slides, exercises, assessments, code samples, synthetic and generalized datasets, frameworks, methods, branding, and the design and structure of the Site — are owned by Tektari or our licensors and are protected by copyright, trademark, and other intellectual-property laws. “Tektari” and our logos and marks are our property. Except for the limited license in Section 6.2, no rights are granted to you.
Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Program content and synthetic datasets you have purchased, solely for your own learning and internal professional development, for the duration of your access window.
This license does not permit you to:
Applying the skills and general knowledge you learn to your own work is encouraged and is exactly the point — what is restricted is redistributing our materials and datasets themselves. The synthetic datasets are provided for teaching only and must not be presented as, or relied upon as, real-world data.
We reserve all rights not expressly granted.
If you send us suggestions or feedback, you grant us a perpetual, irrevocable, royalty-free license to use it without restriction or obligation to you.
”User Content” means anything you submit, post, or upload through the Services — for example, exercise submissions, forum or community posts, questions, and project artifacts (synthetic only, per the clean-room rule).
This section is important. Please read it carefully, especially if you work in safety-critical industries.
Tektari is education, not advice. The Services, including all Program content, datasets, tools, examples, and any outputs generated during exercises, are provided for educational and informational purposes only. They are not engineering, architectural, structural, geotechnical, environmental, legal, financial, medical, occupational-health-and-safety, or other professional advice, and they do not constitute a professional opinion, certification, or recommendation for any specific real-world project, asset, or decision.
No professional relationship. Using the Services does not create an engineer–client, lawyer–client, or other professional or fiduciary relationship between you and Tektari. We are not your engineer of record, designer of record, or advisor of record.
Synthetic data, illustrative results. Our datasets and worked examples are synthetic and generalized. They are designed to teach methods, not to represent any real asset, site, system, or condition. Results shown are illustrative and may not generalize to your situation.
AI outputs can be wrong. AI systems — including any models, tools, or workflows taught or used in the Services — can produce inaccurate, incomplete, biased, outdated, or unsafe outputs. You must independently verify any output before relying on it, and apply your own professional judgment, applicable codes, standards, and regulations.
A qualified human owns every sign-off. Nothing you learn or generate through the Services replaces the review, judgment, stamp, seal, or approval of a qualified, licensed, and accountable professional. For any real design, build, operation, inspection, or safety-related decision, a competent human must own the sign-off and bears responsibility for it. Do not deploy course outputs into production, safety-critical, or regulated contexts without appropriate professional review and validation.
As-is. To the maximum extent permitted by law, the Services are provided ”as is” and ”as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, secure, or that any particular outcome (including learning, certification, employment, or commercial result) will be achieved.
Your responsibility. You are solely responsible for how you use what you learn, including compliance with all laws, codes, standards, permits, and professional obligations applicable to your work.
To the maximum extent permitted by applicable law:
No indirect damages. Tektari and its directors, officers, employees, contractors, instructors, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, or for any damages arising from reliance on the Services or any output, even if advised of the possibility of such damages.
No liability for real-world reliance. Without limiting Section 8, Tektari is not liable for losses, injuries, damages, regulatory actions, or claims arising from your application of educational content or AI outputs to real-world assets, projects, designs, operations, or safety decisions. A qualified human owns every sign-off.
Liability cap. Tektari’s total aggregate liability arising out of or relating to these Terms or the Services, from all causes and under any theory of liability, will not exceed the greater of (a) the amount you paid to Tektari for the specific Program giving rise to the claim in the twelve (12) months before the event giving rise to liability, or (b) CAD $100.
Carve-outs. Nothing in these Terms limits liability that cannot be limited or excluded under applicable law (for example, certain consumer-protection rights, fraud, or liability for death or personal injury caused by negligence where such limitation is not permitted).
Some jurisdictions do not allow certain limitations or exclusions, so some of the above may not apply to you. In that case, our liability is limited to the greatest extent permitted by law.
You agree to indemnify and hold harmless Tektari and its directors, officers, employees, contractors, instructors, and licensors from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your misuse of the Services; (b) your breach of these Terms, including the clean-room rule; (c) your User Content; or (d) your application of educational content or AI outputs to any real-world project, asset, or decision.
The Services may rely on or link to third-party tools, platforms, and content (for example, payment processors, video hosting, AI providers, or external websites). We do not control and are not responsible for third-party services, and your use of them is governed by their own terms. Links are provided for convenience and do not imply endorsement.
These Terms are governed by the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable there, without regard to conflict-of-laws principles. Subject to any non-waivable consumer-protection rights, you agree that the courts located in Ontario, Canada will have jurisdiction over disputes arising from these Terms or the Services.
⚠️ [Confirm with counsel] — Governing law, venue, and dispute-resolution mechanics (including any arbitration, class-action waiver, or consumer-specific provisions) should be confirmed and tailored by a qualified lawyer for the jurisdictions in which Tektari operates and sells.
We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you (for example, by posting the updated Terms on the Site with a new effective date, or by email). Changes apply prospectively. Your continued use of the Services after changes take effect constitutes acceptance. If you do not agree to the updated Terms, stop using the Services.
